The service

TalkToBoard is a macOS application for recording and producing explainer and screen videos, sold by subscription and distributed as a direct download.

Accounts and activation

You sign in with your email via a one-time code. You are responsible for keeping access to that email secure. Your license is tied to your account and the devices you activate.

License

While your subscription is active, or during a valid trial, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app for your own use.

You may not resell, redistribute, reverse-engineer, or attempt to circumvent the app's licensing or activation, except where such restriction is prohibited by law.

Free trial

New customers can start a 7 day free trial. The trial requires a payment method, and unless you cancel before it ends, it converts into a paid subscription at the plan price. You can cancel at any time during the trial from the customer portal linked in the app.

Subscriptions and billing

Subscriptions are offered monthly or yearly and are sold and billed by Polar as Merchant of Record. Prices are shown at checkout and include any applicable tax. Subscriptions renew automatically at the then-current price until cancelled.

You can manage, change, or cancel your subscription, and update payment details, through the customer portal linked in the app. Cancelling stops future renewals; access continues until the end of the paid period.

If a payment fails, access may be suspended until payment succeeds.

Referral program

Active subscribers can refer others using their referral link. The referrer earns a 40% commission on every payment a referred person makes, for as long as that person stays subscribed. The referred person receives 20% off their subscription, applied to every payment while it remains active.

Commission is earned on each payment once it clears the refund window. Rewards are paid manually, typically monthly, to the PayPal account you connect. Self-referrals, fake accounts, and other abuse are not eligible, and we may withhold, reverse, or void rewards we believe are fraudulent or made in bad faith.

We may change or end the referral program, or its reward amounts, at any time. Commission already earned and cleared will still be honored.

Acceptable use

You agree not to use TalkToBoard to break the law, infringe others' rights, or disrupt or attack the service.

Your content

Recordings and projects you create are yours. We do not claim ownership of them, and we do not access them. The app, its software, and the TalkToBoard brand remain ours.

Consumer guarantees

If you are in Australia, our services come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, you are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have problems with the service fixed if it is not of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

Disclaimers

Except for the consumer guarantees and other rights described above, and to the maximum extent permitted by law, the app and website are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that it will meet every requirement.

Limitation of liability

Where our liability for failing to comply with a consumer guarantee can lawfully be limited, it is limited, at our option, to resupplying the service or paying the cost of having it resupplied.

Subject to your non-excludable rights, and to the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss, or for any loss of data, profits, revenue, or goodwill, arising out of or in connection with the service, and our total liability for any claim is limited to the amount you paid us for the service in the 12 months before the claim.

Termination

You can stop using the app and cancel at any time. We may suspend or terminate access for breach of these terms or for fraud or abuse. Termination does not affect any consumer guarantee or refund right you have under applicable law.

Governing law

These terms are governed by the laws of Western Australia, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State or Territory. If you are a consumer in another country, you keep the benefit of any mandatory consumer protections of the place where you live.

Changes

We may update these terms. Material changes will be reflected by updating the date at the top of this page, and continued use means you accept the updated terms.
